Terms of Use
These terms are the basic rules for using Audiolox. If you upload music, the Artist and Label Agreement applies as well.
1. About these terms
Audiolox is operated by Belmont Labs Inc., a Washington corporation ("Audiolox", "we", "us"). These terms cover audiolox.com, the admin for artists and record labels, and the Audiolox apps (together, the "service").
By creating an account or using the service, you agree to these terms. The Privacy Policy, the AI Music Policy and the Copyright and Takedown Policy are part of these terms. If you upload music or are credited on a song, the Artist and Label Agreement also applies.
2. Who can use Audiolox
- You must be at least 18 years old, or the age of majority where you live if that is higher.
- You must be able to enter into a binding contract.
- If you register for a company, such as a record label, you confirm that you have authority to bind that company.
3. Your account
- Give accurate information when you register and keep it up to date.
- Keep your password confidential. You are responsible for what happens under your account.
- Tell us right away at legal@audiolox.com if you believe someone else has used your account.
4. What you may not do
- Upload music, artwork or other material that you do not have the rights to.
- Give false credits, false shares, or a false declaration about the use of AI.
- Create plays artificially, for example with bots, scripts, paid play services, or by playing songs only to raise the count.
- Pretend to be another person, artist or label.
- Copy, record, decrypt or extract music from the service, or try to get around LoxSync Technology or any other protection.
- Interfere with the service, probe it for weaknesses, or collect data from it by automated means.
- Use the service to break the law or anyone else's rights.
5. Your content
You keep ownership of your music and everything else you upload. You give Audiolox the rights we need to run the service, as set out in the Artist and Label Agreement.
Your profile name, avatar and bio are public. You allow us to display them on the service and when we present your music.
6. Our service and technology
Audiolox, LoxSync Technology, our software, our designs and our names and logos belong to Belmont Labs Inc. These terms let you use the service. They do not give you any other rights in it.
7. Payments
Payments to artists, labels and other credited people are covered by the Artist and Label Agreement.
Listener subscriptions. Listening on Audiolox requires a paid subscription, bought on audiolox.com. The price and any free trial are shown before you subscribe.
- A free trial is offered once per account. If you do not cancel before the trial ends, your card is charged the monthly price on the day it ends.
- Students. A student may be offered a longer free trial. To get it you confirm an email address given to you by your school, by entering a code we send to it. A school address can be used for one student trial, on one account. The student trial takes the place of the regular trial. It is not added to it.
- The subscription renews each month and your card is charged each month until you cancel.
- You can cancel at any time from your account page. You keep access until the end of the period you have paid for, and you are not charged again.
- Payments are not refunded for part of a period, except where the law requires it.
- Taxes may be added where they apply. If we change the price, we will tell you before the new price is charged.
- Payments are handled by Stripe. Audiolox does not store your card number.
Listening in the app.
- You subscribe on audiolox.com and sign in to the Audiolox app with the same email and password. There is no sign-up and no payment inside the app.
- Your subscription is for you. An account can be signed in on a limited number of devices at a time. The number is shown on your account page and in the app, where you can also remove a device.
- Music in your library is saved on your device in a protected form so that it plays without a connection. The app needs to go online from time to time to confirm your subscription. The app tells you how often. Saved music stops playing when your subscription ends, when a device is removed from your account, or when you sign out.
- Music is offered under licenses from the artists and record labels who own it. A song may be available in some countries and not others, may be available to play but not to keep in a library, and may be taken down by its owner at any time. When music in your library is taken down, it leaves your library.
- Plays you make without a connection are reported the next time the app is online, so that the people who made the music can be paid.
- Audiolox may give an account a guest pass, which allows listening without payment until a stated date. A guest pass can be ended at any time.
8. Suspending or closing an account
You may close your account at any time. A listener can delete their account under Settings in the app, or on their account page at audiolox.com. Deleting an account cancels the subscription at once, deletes the library, playlists and preferences, and signs out every device. It cannot be undone, and the part of a period already paid for is not refunded, except where the law requires it. We may suspend or close an account, or remove content, if these terms are broken, if we are required to by law, or if we reasonably believe an account is being used for fraud or is putting others at risk. Where we can, we will tell you why.
After an account is closed, we keep the records the law requires us to keep, including records of agreements and payments.
9. Changes to the service
We are still building Audiolox. We may add, change or remove features. If a change materially reduces what you can do, we will give reasonable notice.
Artificial intelligence. The website and the admin include a help assistant powered by artificial intelligence. It explains how Audiolox works. The app includes an assistant, also powered by artificial intelligence, that can find music and, when you ask it to, add music to your library, make playlists and start playback. It cannot make payments or change your account. Short messages in the app about new music, and translations of our messages into your language, are written by artificial intelligence and are marked as such.
What an assistant says, and what such messages say, can be wrong and is not legal, tax or financial advice. An assistant chooses music by its title, artist, genre and label. It does not listen to it. If an answer differs from these terms or from another Audiolox document, the document applies.
Messages and notifications. We send messages to the Messages screen of the app about your account and about music, and, if you allow it on your device, notifications. You can switch each kind of notification off in the app's Settings. Messages about your account, such as a failed payment, still appear in the app.
10. No warranties
The service is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the service will be uninterrupted or free of errors.
11. Limit of liability
To the fullest extent the law allows, Audiolox is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for all claims relating to the service is limited to the greater of the amount we paid you in the twelve months before the claim arose, or one hundred US dollars (US $100).
Some places do not allow these limits. Where that is the case, they apply only as far as the law permits.
12. Your responsibility for claims
If someone brings a claim against Audiolox because of your content, your use of the service, or your breach of these terms, you will defend us and cover the resulting losses and costs, including reasonable legal fees.
13. Changes to these terms
We may update these terms. Each version has a number and an effective date. For a material change, we will give at least 30 days' notice by email or in the admin, and we may ask you to accept the new version. Your account keeps a record of each version you accepted.
14. Governing law and courts
These terms are governed by the laws of the State of Washington, USA, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Washington, and you and Audiolox consent to those courts.
15. General
- These terms and the documents they refer to are the whole agreement between you and Audiolox about the service.
- If part of these terms cannot be enforced, the rest still applies.
- If we do not enforce a term, that is not a waiver of it.
- You may not transfer your rights under these terms without our consent. We may transfer ours as part of a merger, sale or reorganization.
